Supreme Court: 'If NOTA gets the most votes then elections should be held again', Supreme Court seeks reply from EC on the petition demanding
Supreme Court On NOTA: A petition was filed by motivational speaker Shiv Kheda regarding NOTA, in which re-election was demanded in case of getting more votes.
Supreme Court Hearing on NOTA: An important issue related to voting was heard in the Supreme Court on Friday (26 April 2024) amid the second phase of voting for the Lok Sabha elections 2024. In this, the Supreme Court has sought a reply from the Election Commission on the demand for re-election if NOTA gets more votes than any other candidate. The court heard this petition filed by motivational speaker Shiv Kheda.
Let us tell you that at present the system is that the one who gets the most votes among the candidates is considered the winner. The petitioner's lawyer said that due to this arrangement, a candidate from Surat has been elected unopposed. However, it is important to understand that this is a subject for detailed hearing. This petition will not affect the results of Surat seat or any aspect of the current Lok Sabha elections .
The petitioner has made these demands
In this petition filed by Shiv Kheda, there has also been a demand to make a rule that the candidates who get less votes through NOTA should be banned from contesting any kind of elections for 5 years. Apart from this, NOTA should be seen as an imaginary candidate. The case is being heard by the bench of CJI DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra.
What is NOTA?
The option of NOTA came in India in 2013 after the direction of the Supreme Court. Nun of the Above i.e. NOTA is a voting option, under which the voter can choose this option if he does not like any candidate. People's Union for Civil Liberties had fought a long battle to get it started in India. It is important to understand here that NOTA in India does not have Right to Reject. According to the current law, if NOTA gets more votes then it has no legal consequences. In such a situation the next candidate will be declared the winner.
